6.2 The provisions of this Agreement concerning prohibited activities, copyrights, trademarks, Submissions, disclaimers, limitation of liability, resolution of disputes, indemnity and jurisdictional issues shall survive any termination.

7. Disclaimers; Limitation of Liability

7.1 THE SERVICES AND CONTENT OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS, AS AVAILABLE.” ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXCLUDED TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.

7.2 EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL Plated Posts BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Plated Posts’S LIABILITY TO YOU FOR ANY DAMAGES EXCEED US$50.00.

7.3 Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so these limitations may not apply to you.

9. Dispute Resolution

You waive your right to participate in a class action or class arbitration. Claims must be brought within one (1) year after the cause of action arises, or such claim is barred.

10. Users Outside of the United States

If you choose to access the Services from outside the United States, you do so on your own initiative, and you are solely responsible for complying with applicable local laws.

11. Miscellaneous

All provisions of these Terms of Service are severable; the unenforceability or invalidity of any provision will not affect the enforceability of the remaining provisions.
